Here is another case of HMRC persecuting a pensioner.

My wife has very simple tax and income affairs. She has a state Pension plus a small private Pension. Last year we discovered that HMRC were overtaxing her. Eventually HMRC agreed that my wife had overpaid Income Tax for the year 2010/2011- by £297. This money was finally repaid by HMRC in October 2012. NOW HMRC have informed my wife that she owes them £297 in unpaid Income Tax.

My wife phoned HMRC this morning to ask what is going on; the answer from HMRC was incredible. Apparently, HMRC automatically claim an UNDERPAYMENT in Income Tax for the next tax year if a pensioner has received a tax rebate for a previous tax year. This is nothing less than persecution, and the assumption of guilt without investigation or trial.

How many pensioners are unknowingly being robbed blind by HMRC because of of a loss of mental powers in their old age? I suspect a very large number of them are being deliberately robbed.

There are two pensioners in my household, myself and my wife, and both of us have a very hard time with HMRC EVERY year. Fortuantely, neither of us have yet lost our mental powers.

My wife was told over the phone yesterday that the tax code generation system is set up to automatically create a personal tax code on the basis that a previous year's rebate would assume 'underpayment' of tax in future years. When my wife pushed the HMRC 'advisor' that this was wrong and immoral, the advisor responded with “your tax code is not set in stone, you can get it changed, but you first have to provide us with the proof.”

So there you have it; HMRC automatically make errors in setting tax codes, and leave the taxpayer to first discover there is an error, then enter into combat with HMRC to prove innocence before the money is returned very much later - and only after government and BoE have conspired to devalue the currency.

So now the presumtion of inocence until proven guilty, the backbone of British justice has been reversed, and Magna Carter sidelined. I would never have believed HMG would be above the Law of the land. My Dad was right, we are ruled by one set of crooks, or another set of crooks. :shock: :? :cry: :x
